STUDENT SMOKING/TOBACCO USE

Student possession or use of any tobacco product, smokeless tobacco, or any smoking object/device, including electronic cigarettes, advanced personal vaporizers, vape pens, vape mods and similar devices, shall be prohibited on and in all Avoyelles Parish School Board property and vehicles, and at all school-sponsored or school-approved functions.  School Board property shall include any elementary or secondary school grounds or buildings, any portable buildings, field houses, stadiums, equipment storage areas, vacant land, or any other property owned, operated, or leased by the School Board.

REFERRAL OF STUDENT REQUIRED

When a student is found in possession of or using any type of electronic smoking object/device including electronic cigarettes, advanced personal vaporizers, vape pens, vape mods and similar devices, the device will be confiscated and tested by a qualified professional for evidence of a controlled substance.  Designated personnel shall report the findings to the parent.  If the results of the test are non-negative, further testing will occur by a state licensed or federally certified laboratory and a certified Medical Review Officer (MRO) shall review and rule on all confirmed non-negative drug test results.  If further testing confirms a controlled substance is present policy JCDAB, Student Alcohol and Drug Use, will be followed and students will be disciplined according to policy.

COMPLIANCE AND ENFORCEMENT

Violations shall subject the student to appropriate disciplinary action and the student may also be referred to cessation counseling services.

Students under the age of eighteen (18) who are found with tobacco products on school grounds, on a school bus, or at a school related activity shall be referred to appropriate law enforcement agencies for prosecution under state law.

COMMUNICATION OF POLICY

Parents and students shall be informed of this policy through written notice, student handbooks, and policy manuals.
